Any man, woman or child, whether passenger, pedestrian, or cyclist, whether you are a South African citizen or a foreigner, is eligible to claim from the Road Accident Fund.
If you have lost a family member, who was the breadwinner of your family, as a result of a motor vehicle collision, you my claim for loss of support, as well as funeral expenses from the Road Accident Fund.
The only exception is those who are the sole cause of the accident. E.g., as a driver if you lose control and crash into a tree without any other party involved, you DO NOT have a claim against the RAF.
Additionally, a road accident fund claim is only claimable where there has been negligence on one or both or all sides of the accident.
